Terms of Service
These terms cover this website and the Diomedes service, whether you use it on the Free plan or pay for Pro.
Effective 22 August 2026Last updated 22 August 2026
1. Agreement
By using https://diomedes.app or the Diomedes service, you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you can bind it. If you do not agree, do not use the service. The service is provided by Gage Willette, 805 W Madison St, Tallahasse, FL 32304.
2. Plans and limits
Every account starts on the Free plan. Free includes one workspace you create, membership of up to three workspaces other people create, and 1 GB of pages, files and history per workspace. It includes the whole editor. It does not include creating or editing Draw.io and Excalidraw diagrams, which anyone can still view.
Pro is a subscription for one account. It removes the workspace limits, raises storage to 25 GB per workspace, and unlocks creating and editing Draw.io and Excalidraw diagrams. Plans belong to people, not workspaces: a workspace follows the plan of the account that owns it.
If a Pro subscription ends, nothing is deleted. Workspaces beyond the first one you created become read-only until you upgrade again or move their pages elsewhere. Existing Draw.io and Excalidraw diagrams keep rendering but cannot be edited. A workspace over its storage limit stops accepting uploads at once and has thirty days to be brought back under the limit; after that we may remove data, starting with the largest files, then the trash, then the largest pages, until it fits. You can download everything in a workspace at any time, and we will show you that option whenever a workspace is over its limit.
3. Accounts
- Give accurate signup details and keep them current.
- You are responsible for what happens under your account and for your users’ conduct.
- Keep credentials secret, and tell us promptly if you suspect they have been compromised.
- Workspace owners control roles and access within their workspace, not us.
4. Acceptable use
You agree not to use the service to:
- break the law, or infringe someone else’s intellectual property or privacy;
- store or distribute malware, or material that is unlawful or abusive;
- probe, scan, overload or interfere with the service, or attempt to reach data belonging to another workspace;
- work around plan limits, for example by holding several accounts to gain more free workspaces or storage;
- resell or provide the service to third parties as your own.
Automated access through the API is welcome and expected — that is what the tokens are for. Keep it within any documented rate limits.
5. Fees, billing and cancellation
- Pro is billed per account, in advance, monthly or yearly as you choose. Prices are in US dollars and exclude taxes, which are added where required.
- Payments are processed by Stripe. Your card details go to Stripe, not to us; we receive confirmation of payment and the last four digits of the card.
- You can cancel at any time from the billing screen; Pro runs to the end of the paid period and does not renew. Fees already paid are not refundable except where the law requires it.
- If a renewal payment fails we will retry and tell you. If it keeps failing, the subscription ends and the account returns to Free as described in section 2.
- We may change prices with at least 30 days’ notice, effective at your next renewal.
6. Your content
You keep every right you have in the pages, comments, diagrams and files you put into Diomedes. You grant us only the narrow licence we need to run the service for you — to store, back up, transmit, index and display your content, and to derive the blocks and embeddings that make search work. That licence exists to operate the product and ends when you delete the content or close the workspace.
You are responsible for having the right to store what you store, and for making sure your use of Diomedes fits your own obligations — including not putting regulated data somewhere your policies do not allow.
You can export everything at any time — any page as Markdown or HTML, any page tree or whole workspace as a ZIP — and we will not hold your data hostage to keep you on a plan.
7. Our intellectual property
The Diomedes name, logo, software and this website’s design and copy remain ours. These terms grant you no right to use our branding beyond describing that you use the product.
8. Availability
We aim to keep the service available around the clock and will give advance notice of planned maintenance where we reasonably can. Neither plan carries a contractual uptime commitment.
9. Warranties
The service is provided “as is”. To the maximum extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that it will meet every requirement you have.
10. Limitation of liability
To the maximum extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of the service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot lawfully be excluded.
Keep your own backups. Ours exist to recover the service, not to serve as your archive of record.
11. Suspension and termination
We may suspend or terminate an account that breaches these terms, that puts the service or other customers at risk, or that is significantly overdue on payment. Where circumstances allow, we will warn you first and give you a chance to put it right. On termination you may export your data for 30 days, after which we delete it.
12. Changes to these terms
We may update these terms. For material changes affecting paying customers we will give at least 30 days’ notice, and continued use after that counts as acceptance.
13. Governing law
These terms are governed by the laws of FL, USA, and its courts have exclusive jurisdiction, without affecting any mandatory consumer rights you have where you live.
